Reasons

Both parties attended the hearing.
The landlord has applied for water rates of $700.65 for the period from 18 July 2025 to 19 January 2026.
The tenancy started in 2016 and has been managed by the same property management company since then. Water rates were billed to the tenant at regular intervals until June 2025.
The Property Manager claims that the premises were sold at that time and neither the property manager nor the new owner arranged to receive the water rates from the water authority/supplier.
The Property Manager became aware of the issue in March 2026, when it had a change of personnel. The person currently managing this tenancy immediately recognised that water rates bills had not been received and charged on to the tenant. Water rates for the period July 2025 to January 2026 were billed to the tenant in March 2026.
A tenant is responsible for all outgoings in respect of the premises that are exclusively attributable to their occupation of the premises or to their use of the facilities (see s 39(3) RTA). Therefore, tenants are only liable for the electricity, gas, telephone and internet they use, and for water charges based on consumption (s 39(4) RTA). They are not liable for fixed water charges.
In relation to water charges, the District Court held in Woollams v Simpson (DC Auckland CIV-2005-004-1583, 16 March 2006), that there was an implied term in the tenancy agreement that the landlord would provide water accounts at regular intervals, and within a reasonable time, to enable payment to be made. The Court determined that, because the landlord had failed to do so, the tenant was only required to pay the last two accounts.
In this case, the landlord and property manager have failed to provide the water rates from July 2025 to January 2026 to the tenant in a timely manner. I award the landlord the water charges from the last two accounts provided. The balance of the claim is dismissed.
As the landlord was partially successful, I have also awarded reimbursement of the Tribunal application fee. This situation has arisen through no fault of the tenant, I have suppressed her details.
