The tenancy at 99A Puriri Street, Gonville, Whanganui is terminated at 5pm Friday 22 May 2026 and possession granted to the landlord, Bartley Real Estate Limited As Agent For Payman Rowhani – Farid.
Kelly-Anne Michelle Webster must pay Bartley Real Estate Limited As Agent For Payman Rowhani - Farid $3,613.71 immediately, as calculated in the table below.

Reasons

The landlord attended the hearing. There was difficulty with the video link and so both parties were phoned.
The landlord has applied for termination of the tenancy, rent arrears and refund of the bond.
The landlord provided rent records which show that the rent was at least 21 days in arrears on the date the application was filed. Section 55(1)(a) says that the Tribunal must terminate the tenancy.
The tenant said that at the start of the tenancy there was a problem with the toilet. The landlord halved the rent for 11 weeks and had said that she could use the toilet in the front flat. When the tenant returned from holiday and asked for the key, the other flat was occupied and so she could not use it. She had to walk 1.3 kilometres to use a toilet.
The rent records show that the rent charged for 11 weeks was half the usual rental. The property manager said that the tenant had told them that she did not need to use the toilet in the front flat. The agreement about the rent reduction was recorded in writing. There was no written agreement about use of the toilet.
The tenant did not dispute that. She did not complain to the landlord about lack of access to a toilet during the tenancy. She has not paid any rent since 3 March. She said that she was annoyed that she had been given a 90 day notice to terminate.
The tenant has filed no counterclaim against the landlord.
The tenancy is terminated. The landlord seeks possession on Friday 22 May 2026. The rent to that date has been calculated and included in the order.
There is no application for refund of the bond.
Because Bartley Real Estate Limited As Agent For Payman Rowhani - Farid has wholly succeeded with the claim I must reimburse the filing fee.
