Reasons

The landlord attended the remote hearing held on 16 July 2026. The tenant did not attend the hearing. An attempt was made to join the tenant to the hearing by telephone, but the call went to voicemail.
After the hearing concluded, Tenancy Services advised that the tenant had called to say that he had missed a call and asked to be called again.
The landlord and the tenant were contacted again and the hearing was resumed.
The landlord has applied for termination of the tenancy for breach of the tenant’s obligations.

Should the tenancy be terminated?

The Tribunal may terminate a tenancy for breach where, due to the nature or extent of the breach, it would be inequitable to refuse to terminate. See section 56(1) Residential Tenancies Act 1986.
Where the breach is capable of remedy the landlord must first serve a notice on the tenant requiring them to remedy the breach within at least 14 days and establish that the tenant has failed to do so.
The tenant has breached their obligations by failing to comply with the tenant responsibility to keep the premises reasonably clean and reasonably tidy 1 .
The landlord served a 14-day notice on the tenant on 9 June 2026, and the tenant did not remedy the breach within the required period.
It would be inequitable to refuse to terminate the tenancy because the premises are in a significantly unclean state and in addition, potentially in an unsafe state due to fire ingress issues.
The landlord produced photographs from 9 June 2026 when the notice was served. Those photographs showed the living room was cluttered with items and the kitchen was very dirty. The landlord produced photographs dated 30 June 2026 showing no change to the condition of the property from 9 June 2026.
On the day before the hearing the landlord attended at the premises and provided further photographs. One photograph shows that the tenant has cleaned the stove in the kitchen.
The tenant said that the lounge area contains his personal stuff and that he has cleaned the outside area and the kitchen. He said he has been sick. He also said that further cleaning was carried out after the landlord took photographs on 15 July 2026 at 4.15pm. The tenant did not produce any photographs to support this.
Given the condition of the premises and the tenant’s failure to remedy the breach within the timeframe the tenancy is terminated.
Because Otautahi Community Housing Trust has wholly succeeded with the claim I must reimburse the filing fee. 1 Section 40(1)(c) Residential Tenancies Act 1986
