Both parties attended the hearing.

This was a fixed term tenancy which only began on 12 January 2026 and was due to end on the 30 October 2026. In March the tenant asked the landlord if he could end the tenancy early the tenancy. The landlord agreed on the basis that the tenant would give back the property and pay all rent until the termination date.

The tenant had invited his acquaintance Raghu to stay with him whilst Raghu recuperated from an illness.

The tenant wanted to move out, but Raghu would not leave saying that he had nowhere else to go, this meant that the tenant could not give back vacant possession of the property to the landlord.

The landlord has applied for termination of the tenancy and possession of the property. At today’s hearing the tenant agreed to terminate the tenancy and to grant possession back to the landlord.

I am satisfied that the tenancy has terminated by agreement and that the landlord is entitled to immediate possession.

I record that Raghu is not a tenant and has no legal right to possession of the property. He must leave the property. Both the landlord and the tenant want him to leave. Possession order may be carried immediately.

Usually, a possession order cannot be enforced (an eviction actioned) until 48 hours after the order is made. However, I can grant leave for the order to be enforced immediately; see section 138(1) of the District Court Act 2016. Section 106(2) RTA states that s 138(1) applies as if the reference to a District Court Judge, were a reference to a Tenancy Adjudicator.

The landlord may make an immediate application for an eviction warrant to have bailiff and/or police assistance to obtain possession, if required.

I consider it appropriate to make this order because the landlord and the tenant both want the tenancy to end and for the landlord to have immediate possession. The parties have tried for weeks to ask Raghu to leave, and he has not done so willingly. I consider that there is a risk to property if a person who has no legal right to be at the property and who has been asked to leave and does not remains at the property even for a few days. The landlord provided a rent ledger that proves the amount of rent owed to today’s date. Filing fee and name suppression.
