Reasons
- The landlord attended the hearing which was held by videoconference. The tenants didn’t attend and couldn’t be reached on the number given in the Notice of Hearing, which was properly served.
- The landlord has applied for termination of the tenancy for abandonment, rent arrears and refund of the bond.
- An application for termination under the expedited abandonment provisions 1 was declined by Order dated 20 April 2026
Should the tenancy be terminated?
- The Tribunal may terminate the tenancy where the premises have been abandoned and rent is in arrear at the hearing date. 2
- A tenancy is abandoned where the tenant leaves the premises without reasonable excuse, not intending to return or to meet their obligations, and fails to notify the landlord.
- On 8 April 2026 during a routine inspection, the property manager discovered that the premises had been searched by police under a search warrant. Power had been disconnected. It did not appear that anybody was living in the premises.
- The property manager has visited the premises regularly since then and there is no sign of the tenants being their or occupying the premises. Rent has not been paid since 29 March 2026.
- I find that the tenants have abandoned the premises. Because the premises have been abandoned, and rent is in arrears, the tenancy is terminated immediately.
How much does the tenant owe?
- The landlord provided rent records which prove the amount owing at the end of the tenancy.
- This is a fixed term tenancy so rent in lieu of notice is not included. Further applications are likely so the bond held in excess of the rent arrears and filing fee should remain at the Bond Centre in the meantime. 1 S.91AA RTA 2 S.61 RTA
- Because [The applicant/s] has wholly succeeded with the claim I must reimburse the filing fee.
