Reasons
- Mr Barakat and Ms Volschenk attended the hearing conducted remotely. Mr Simpson did not attend but I am satisfied he was served with the Notice of hearing at his address for service.
- The landlord has applied for termination of the tenancy, rent arrears and refund of the bond. It is understood Ms Volschenk has left the tenancy but the landlord said Ms Volschenk had always paid her half share of the rent but Mr Simpson has not paid rent for some time. As the parties are joint and severally liable for any debt the order has been made against both parties.
- Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.
- The landlord provided rent records which prove the amount owing at the end of the tenancy.
- Because Duane Vivian Barakat has wholly succeeded with the claim I must reimburse the filing fee.
