The Landlord has produced the tenancy agreement, a rent summary and bank account records. Those documents show: (a)The tenancy started on 18 May 2025. (b)The rent was $950 per week. (c)The Tenant paid a bond of $3,800 by two payments of $800 on 12 September 2025 and $3,000 on 10 October 2025. (d)The rent payable over the life of the tenancy, up to and including the date of this decision, was $53,471.43 (56 weeks and two days @ $950 per week) (e)The total rent paid by the Tenant is $37,200.

That information appears to show rent arrears of $16,271.43 as at today’s date. The Landlord seeks to recover only $15,200. Quite how that figure was calculated is unclear and seems to be based on the Landlord’s own spreadsheet of rent payments. But because the amount claimed by the Landlord is lower than the rent arrears I have calculated, I will proceed on the basis of the amount claimed by the Landlord.

The Tenant does not dispute the debt. It seems she has, like many New Zealander’s, struggled financially in recent times, leading to these significant rent arrears.

I therefore find that the Tenant owes the $15,200 rent arrears claimed by the Landlord. Termination and possession

Because the rent is in arrears by at least 21 days, I must make an order terminating the tenancy. 1 I see no basis for making this order conditional. 2 Given the extent of the rent arrears, and the fact that the rent summary shows other instances of unpaid rent throughout the tenancy, I cannot be satisfied that the Tenant will promptly remedy this breach or that a similar breach will not occur in the future. 1 Residential Tenancies Act 1986, section 55(1)(a). 2 Under section 55(1A) of the Residential Tenancies Act 1986, I can make a termination order conditional, but only if I am satisfied that the tenant will pay the rent within a specified time and that it is unlikely that the tenant will fail to pay the rent in the future.

I order that the tenancy is terminated under section 55(1)(a) of the Residential Tenancies Act 1986 effective immediately. Possession is also granted to the Landlord. 3 Filing fee and name suppression

The Landlord has been wholly successful in his claim. He is entitled to recover the filing fee of $28. I also order that the Landlord’s name and identifying details are suppressed. Bond
