Reasons

Both parties attended the hearing by video.
The landlord withdrew the claim for cleaning costs.
The landlord has applied for rent arrears, compensation and reimbursement of the filing fee.
The landlord has provided rent records which prove the amount owing. The tenant did not dispute that the rent was owing saying she did not pay the rent because she needed the money for moving costs. A tenant must pay the rent when due and payable under the tenancy agreement. See section 40(1)(a) Residential Tenancies Act 1986,RTA.
The landlord sought compensation for an electrical account dated 12 January 2026.The landlord said that according to the invoice the power points were tested and there was no tripping and everything tested perfectly. The owner questioned their liability for this cost.
A tenant is liable for damage that occurs during a tenancy because of their careless or intentional actions. See section 49B RTA. No evidence was provided that the tenant had caused any damage.
The tenant disputed telling the electrician that her vacuum cleaner was ‘a bit faulty’ as was recorded in the invoice, saying that it was new and still under warranty.
The tenant said that she smelled burning and was concerned so raised the issue. This is a responsible action, and tenants are entitled to report concerns relating to health and safety matters. I find that this was a reasonable action as it was not disputed that there was a smell of burning. The electrician reported it was the tenants’ vacuum, the tenant disputed this. Landlords are responsible for maintenance matters.
This claim is dismissed.
The tenant submitted late evidence for the hearing and in this evidence raised some concerns about the tenancy. At the hearing she said that she had filed a cross application but neither the Tribunal nor the landlord had notification of this. The tenant could not find evidence of a filing fee having been paid and has said that she will make a separate claim with the Tribunal.
The tenant wanted to make sure that the rent arrears were paid and wanted the bond to be released to ensure that this happened. She also offered to sign the bond release form to the landlord if required.
Because [The applicant/s] has substantially succeeded with the claim I have reimbursed the filing fee and granted name suppression as requested.
