The applicant seeks termination of the tenancy for non-payment of rent, recovery of breach-related body corporate fees, painting costs, and the application filing fee.

Is the respondent liable for the rent arrears?

The applicant has provided a rent summary showing rent arrears of $7,200 as at Friday, 26 June 2026.

I am satisfied the rent records accurately record the amounts owing. The applicant has established the rent arrears, and I award the sum of $7,200.

Because the rent is more than 21 days in arrears, the tenancy is terminated (see section 55).

The applicant seeks recovery of breach-related fees arising from two incidents.

The first occurred on 5 May 2026, when CCTV captured the respondent spilling chips in the lift and failing to clean the area. The body corporate investigated the incident, issued breach notices, arranged for the lift to be cleaned, and incurred administration costs. The applicant seeks $276 for the body corporate administration fee and $138 (being $120 plus GST) for the body corporate manager's fee.

The second incident occurred on 9 May 2026. Security staff located spit in the lift and, following a review of CCTV footage, identified the respondent as having spat in the lift. The body corporate again investigated the incident and incurred the same administration and management fees.

I am satisfied these fees were reasonably incurred as a direct consequence of the respondent's actions and their failure to comply with the property rules. The applicant is therefore entitled to recover the body corporate administration fees and body corporate manager's fees claimed in respect of both incidents.

Is the respondent liable for the painting quote?

The applicant also seeks $2,716.88 for repainting the unit.

The applicant says that, during an inspection, hair dye was found to have been applied to the walls. However, no evidence of the alleged damage was produced at the hearing. When I asked whether the painting contractor had inspected the 5496207 3 property, I was advised that they had not and had instead been provided with photographs. Those photographs were not before the Tribunal.

The quotation relied upon appears to be an estimate based on repainting the entire apartment rather than an assessment of the specific damage said to have been caused by the respondent.

On the evidence before me, this claim is premature. The applicant should first regain possession of the premises. Once possession has been obtained, any damage can be properly assessed and supported by appropriate evidence. If a substantiated claim remains, it may be brought at that time.

Accordingly, the painting claim is dismissed. Filing fee

As the applicant has been substantially successful in the application, I have awarded the application filing fee.
