(At the date of this order the current rent is $93.00 so the weekly payment due is $103.00). b. Payments will be every Wednesday, with the first payment on 08/07/2026 and continuing every Wednesday until the debt is fully repaid.

Payments will be allocated firstly to rent and then to debt.

If the tenant fails to pay rent or debt within 5 working days of the due dates: a. The tenancy at 14 Kupenga Lane, Beach Haven, Auckland 0626 will terminate and the landlord will have immediate possession of the premises. b. The balance of the debt will be payable immediately.

Reasons

The landlord attended the hearing held remotely today. I telephoned the tenant however the phone went to voicemail. I continued with the hearing as the tenant has been posted notice of the hearing date and time to the tenancy address and been sent several text reminders.

The landlord has applied for termination of the tenancy and payment of rent arrears.

Should a final or conditional termination order be made?

Where rent is at least 21 days in arrears on the date the application was filed, the Tribunal must make either a final or a conditional termination order. See section 55(1)(a) and (1A) Residential Tenancies Act 1986.

A conditional termination order allows a tenant to repay the arrears by a certain date but with termination of the tenancy if payments are not paid on time.

The tenant is not at the hearing. Usually this means that I cannot make a conditional order because the tenant has not told me what they can afford to repay.

In this case, the tenant has already started a repayment plan, and the landlord accepts that it is reasonable. Eight payments have been received.

The eight repayments mean I am satisfied the tenant will pay the debt within the period specified in the order and is unlikely to commit any further relevant breach. I have granted a conditional termination order.

The tenant must pay her weekly rent plus $10.00 towards the debt every Wednesday. If any payment is more than 5 working days late, the tenancy will terminate.

The conditional termination order will lapse if it is fully complied with. If the tenant breaches the order, the possession order may be enforced for 90 days from the first breach. See section 64(4)(b) Residential Tenancies Act 1986. Suppression of names

The Tribunal must usually suppress the name of a party that has been wholly or substantially successful in proceedings unless the Tribunal considers publication is in the public interest or justified because of conduct or other circumstances of the case; section 95A(1) RTA.

The landlord is the government social housing provider responsible for the use of taxpayer funds. My decision is that the public interest in the transparency of its actions means its name should not be suppressed.

The tenant did not apply for suppression of her name and, as the rent is in arrears, I am satisfied the public interest means her name should not be suppressed.
