The landlord has applied for rent arrears, outgoings, compensation, refund of the bond, and reimbursement of the filing fee following the end of the tenancy. Rent and Water
The tenancy ended on 11 March 2026. The landlord provided rent records and water rates invoices which prove the amount owing at the end of the tenancy. Pest Control
The landlord said there were pests present at the end of the tenancy. There are no photographs to show this was caused by a breach of the tenant’ obligations, for example, because of inadequate cleaning or rubbish disposal. I must therefore decline this claim. Tenant Damage
A landlord must prove that damage to the premises occurred during the tenancy and is more than fair wear and tear. If this is established, to avoid liability, the tenant must prove they did not carelessly or intentionally cause or permit the damage. Tenants are liable for the actions of people at the premises with their permission.
Where the damage is caused carelessly, and is covered by the landlord's insurance, the tenant's liability is limited to the lesser of the insurance excess or four weeks' rent. The insurance excess is $1,250.00 and the weekly rent was $650.00.
Tenants are liable for the cost of repairing damage that is intentional or which results from any activity at the premises that is an imprisonable offence. This applies to anything the tenant does and anything done by a person they are responsible for.
The boundary fence and the roof were damaged during the tenancy. The landlord said the tenant drove a vehicle into the fence and walked on the roof to attach Diwali lights, causing denting to the tiles.
The roof quotation is for the repair of the damaged tiles only. The quoted cost of repair is $9,369.05. I have awarded the insurance excess, on the basis that the tenants intended to put up celebratory lights and not to cause damage. I also award the cost of obtaining a quote.
The fence quotation is for $2,018.50. I understood that replacement was more difficult because the original fence was attached to a concrete retaining wall. Again, I have treated this as carelessly caused damage.
A window had come out of its frame and had to be refitted. The damage is more than fair wear and tear, and the tenant has not disproved liability for the damage. I award the cost of repair. Filing Fee
The landlord’s application has been partly successful. I exercise my discretion to award the filing fee.
