Reasons
- Only the landlord attended the hearing, represented by Navi Sandhu.
- I am satisfied that the tenants have been served with the landlord’s application in accordance with the provisions of the Residential Tenancies Act 1986 and so the hearing proceeded in the tenants’ absence.
- This was a fixed term tenancy that began on 8 January 2026 and was to expire on 8 July 2026.
- The landlord has applied for termination of the tenancy for abandonment, rent arrears and refund of the bond.
Should the tenancy be terminated?

- The tenants responded on 22 April 2026 to say that due to an unexpected medical emergency they had to urgently relocate to India. They said that they are not currently in a position to continue paying rent in New Zealand.
- The landlord has received no further communication from the tenants despite sending follow up emails.
- The landlord has been to inspect the property and has found that the tenants have taken most of their belongings with them. The landlord produced photos of the property in evidence.
- Because the premises have been abandoned, and rent is in arrear, the tenancy is terminated immediately.
