On 13 May 2026, the landlord filed an application for termination of the tenancy for rent arrears of at least 21 days, refund of the bond, and reimbursement of the filing fee.

On 26 May 2026, notices of hearing were sent to both parties, advising them of the date and time of this hearing, which was to be held by video link. The notice of hearing contained the link.

Neither party joined the link. A call was made to the landlord, who answered. Calls were also made to both contact numbers provided for the tenant. Both calls went to voicemail. I am satisfied that the tenant has been notified of the date and time of the hearing, and the matter has proceeded in their absence. Law

Section 55(1)(a) of the Act, states that the Tribunal must, subject to section 55(2), terminate the tenancy if at the time of filing an application, the rent is in at least 21 days arrears.

Subsection 55(2) states the Tribunal may refuse to make an order under subsection (1) if, but only if, it is satisfied that the breach has been remedied (where it is capable of remedy), the landlord has been compensated for any loss arising from the breach, and it is unlikely that the tenant will commit any further breach of a kind to which this section applies Analysis and decision

The landlord has provided a rent summary to 13 May 2026, which shows that at the time of filing the application the rent was at least 21 days in arrears. Since then, the tenant has made two weekly rent payments of $365.00 on 27 May 2026 and 03 June 2026 but remains in significant arrears.

I am satisfied that the rent was at least 21 days in arrears on the date the application was filed. As the rent remains in arrears there are no grounds to refuse termination. Accordingly, the tenancy is terminated.

The landlord is awarded rent arrears up to the end of the tenancy. Costs

Section 95A of the Act provides that on the application of a party that has been wholly or substantially successful in proceedings, the Tribunal must order that their name or identifying particulars of that party not be published, unless the Tribunal considers that it is in the public interest to publish the names of the parties, or is justified because of the parties’ conduct, or any other circumstances of the case.

The landlord has been wholly successful and is granted name suppression.

Section 95A (4) of the Act provides that the Tribunal, on the application of any party to the proceedings, or on its own initiative, having regard to the interest of the parties and the public interest, may order that all or part of the evidence, or the name or any identifying particulars of any witnesses or party, not be published.

The landlord has stated that the tenant recently suffered a significant loss, which appears to have affected the tenancy. Considering this, while the facts and reasoning are in the public interest, I do not find that this interest extends to the tenant’s name.
