Should the tenancy be terminated?

The Tribunal may terminate the tenancy where the premises have been abandoned and rent is in arrear at the hearing date. See section 61 Residential Tenancies Act 1986. A tenancy is abandoned where the tenant leaves the premises without reasonable excuse, not intending to return or to meet their obligations, and fails to notify the landlord.

On 24/5/2026 the landlord became aware (or ought to have been aware) that the tenant had abandoned the premises. The landlord went to the property to do a scheduled inspection on 24 May. The tenants were not at the property, the lawns were overgrown, and the tenants pet dog and car had gone, and the house was empty. The neighbours advised the tenants had packed up their belongings into a moving truck and left.

Because the premises have been abandoned, and rent is in arrear, the tenancy is terminated immediately.

How much does the tenant owe for rent?

The landlord provided rent records which prove the amount owing at the end of the tenancy. The amount ordered includes rent in lieu of notice. The rent arrears ordered are calculated until 14 June 2026 as that is 21 days after the landlord became aware the tenants had abandoned the property on 24/5/2026. (S 61(3)).

The landlord is aware that any claims for compensation (including water arrears, rubbish removal, cleaning costs or repairs) will need to be separately filed once they have possession of the property.

As the application is successful the tenant is to reimburse the landlord for the filing fee and the landlord’s request for name suppression is approved.
