The tenant must carry out the following work to the premises, which must be completed by 5pm Wednesday 22 July 2026: a. Remove all inorganic clutter from around the exterior of the property b. Mow front, side and back lawns c. Remove graffiti/writing from internal walls and repair damaged bedroom 1 wall d. Clean premises as follows: -Clean and wipe kitchen oven, rangehood, benches and cabinets -Clean and wipe bathroom shower and bathtub -Clean all floors -Clean windows and windowsills, in particular clean off paw marks
If the tenant fails to comply with Order 1 within 2 working days of the due date:
The tenancy at 7B Valetta Place, Mangere, Auckland 2022 will terminate and the landlord will have immediate possession of the premises.

The landlord has applied for a conditional termination of the tenancy due to breaches by the tenant.

Should a conditional termination order be made?

The Tribunal may terminate a tenancy for breach where, due to the nature or extent of the breach, it would be inequitable to refuse to terminate. Where the breach is capable of remedy the landlord must first serve a notice on the tenant requiring them to remedy the breach within at least 14 days, and establish that the tenant has failed to do so. See section 56(1) Residential Tenancies Act 1986.
The tenant breached their obligations by failing to keep the premises reasonably clean and reasonably tidy. This is a breach of section 40(1)(c) of the Residential Tenancies Act 1986 and clause 9 of the tenancy agreement.
On 9 April 2026 the landlord served a notice to remedy the breach. The notice gave the tenant a staged approach to remedy the breach. The living, kitchen dining areas were to be remedied by 28 April 2026. The bathroom and bedrooms were to be resolved by 13 May 2026 and the exterior by 27 May 2026. The breach was not remedied within the required period.
It would be inequitable to refuse to terminate the tenancy for the following reasons: (a)The landlord has been seeking to work with the tenant since the breach was discovered at an inspection in February 2026. (b)The landlord provided photographs taken in February 2026 which show that the premises are in a very poor state of cleanliness, there is writing/graffiti on walls in the living rooms and bedrooms and damage to the plaster on a wall in bedroom 1. The exterior of the premises has extensive inorganic clutter and the lawns are overgrown. (c)The landlord advised that the property manager discussed with the tenant the work required and referred the tenant to an external support agency for assistance, however, the tenant has not continued engagement with this agency. (d)The property manager observed in March 2026 that the exterior of the property was in the same condition and spoke again with the tenant. She was unable to enter the premises due to the presence of dogs. (e)The landlord issued a notice to remedy dated 9 April 2026 setting out the work required. (f)The landlord inspected the premises on 21 May 2026 and provided photographs showing that although there were some partial improvements the majority of the breach had not been remedied. (g)The property manager advised that she attended the premises today and the lawns are now at the height of the window frames at the back of the premises and there are rodent issues at the premises.
Despite my finding that it would be inequitable to refuse to terminate the tenancy, having heard the evidence including the landlord’s desire to give the tenant one more opportunity to remedy the breach I am satisfied that if the tenant complies with the conditions set out in this order the breach will be remedied and I have granted a conditional termination. See section 78(3) Residential Tenancies Act 1986.
The conditional termination order will lapse if it is fully complied with. If the tenant breaches the order, the possession order is enforceable for 90 days from the first breach. See section 64(4)(b) Residential Tenancies Act 1986.
