On 12 June 2026 the landlord filed an application seeking termination of the tenancy, rent arrears, refund of the bond and reimbursement of the filing fee.

The hearing proceeded by way of video conference. Ms Ming-Chun Wu, Property Manager, appeared on behalf of the landlord. The tenant failed to appear. The Tribunal tried unsuccessfully to join the tenant to the hearing by telephone on two occasions. The Tribunal was satisfied the tenant was properly served with the notice of hearing and the case proceeded in their absence. History of the tenancy

The tenancy commenced on 13 April 2025 with the fixed term ending on 31 January 2026.

On 31 January 2026 the parties entered into another fixed term tenancy due to expire on 31 January 2027.

Should the tenancy be terminated?

Under section 55(1) of the Residential Tenancies Act 1986 (the “Act’), the Tribunal must, subject to subsection 55(2) terminate the tenancy, if at the time the application was filed, the rent was at least 21 days in arrears.

The landlord provided up to date rent records with prove the amount owing.

The application was filed on 16 June 2026. At the date of filing the tenant’s rent arrears totalled $2,545.71. Rent was at least 21 days in arrears and the tenancy is terminated.

The landlord had indicated in their application that the Tribunal could consider making a conditional termination order. This was not pursued at the hearing. In any event the Tribunal would have declined to make such as order for the following reasons: a. The tenant has failed to pay their rent as and when it fell due in breach of their obligations under the Act and the tenancy agreement. b. The tenant has been issued with multiple section 55(1)(aa) recidivist rent arrears notices. c. The tenant’s rent arrears have increased since the application was first filed. d. The Tribunal had no evidence before it to prove the tenant would be able to pay the rent arrears within a specified period or would be unlikely to commit any further relevant breach – see section 55(1A) of the Act.

At the date of hearing the tenant’s rent arrears totalled $3,771.42. The amount claimed is ordered. When should the landlord take possession of the property

The Tribunal has determined that it is appropriate to grant the landlord possession of the property at 11:59pm on Sunday 9 August 2026. This will provide the tenant with an opportunity to vacate the property and return it to the landlord in a reasonably clean and tidy condition without significantly increasing the rent debt. The bond is refunded in full to the landlord to offset a portion of the rent debt.

Because Wan Chien Company Limited has wholly succeeded with the claim I must reimburse the filing fee.
