The landlord has applied for rent arrears, compensation, refund of the bond, and reimbursement of the filing fee following the end of the tenancy.

How much is owed for rent?

The tenancy ended on 24 February 2026. The landlord provided rent records which prove the amount owing at the end of the tenancy.
The landlord agrees to waive the last water bill due to the structure of the downstairs office on the premises being used by the landlord.
The landlord also agrees to reimburse the power charges owed to the tenant; there is a separate check meter to the other property on the premises.

Is the tenant responsible for the damage to the premises?

A landlord must prove that damage to the premises occurred during the tenancy and is more than fair wear and tear. If this is established, to avoid liability, the tenant must prove they did not carelessly or intentionally cause or permit the damage. Tenants are liable for the actions of people at the premises with their permission. See sections 40(2)(a), 41 and 49B RTA.
The blinds were damaged during the tenancy. The damage is more than fair wear and tear, and the tenant has not disproved liability for the damage.
Only the amounts ordered are proved.

Did the landlord harass the tenant?

[The tenant/s] claims the landlord has harassed them.
A landlord must not interfere with the reasonable peace, comfort or privacy of the tenant in their use of the premises. See section 38(2) Residential Tenancies Act 1986.
Breaching this obligation in circumstances that amount to harassment is an unlawful act for which exemplary damages may be awarded up to a maximum of $3,000.00. See section 38(3) and Schedule 1A RTA.
Harassment means "to trouble, worry or distress" or "to wear out, tire, or exhaust" and "indicates a particular pattern of behaviour directed towards another person". MacDonald v Dodds, CIV-2009-019-001524, DC Hamilton, 26 February 2010.
The tenant contends that the landlord had harassed him when the property manager sent him a breach notice on rent arrears (despite the rent not being in arrears) and called him twice on the phone in May 2025 and verbally abused him with rude, entitled, threatening and unprofessional communication.
Having heard from both parties and having viewed the phone records, I do not consider that the landlord has breached the quiet enjoyment of the tenant nor has the landlord harassed the tenant in the use of the premises.
The landlord has duly acknowledged the mistake in the breach notice, which appeared threatening at the start of the new property management of this tenancy. The email reply from the landlord’s office manager promptly apologised for the mistake.
There was only one clear phone call between the property manager and the tenant on 19 May 2025 which was under 2 minutes’ long. The property manager had hung up on previous calls because she herself felt that the tenant had been rude and unprofessional towards her.
Having heard from the parties, I find that the tenant probably gave as good as he got. The parties simply did not get along. But not getting along does not automatically give rise to a valid claim of breach of landlord’s obligation under the RTA.
Rightly so, the property manager then avoided all verbal communication with her tenant until the end of the tenancy in February 2026.
The tenant’s claim for compensation and exemplary damages fails.
I award the tenant the filing fee because the landlord had taken 4 months to file their counterclaim against the bond after the tenancy had already ended in February 2026. This delayed the tenant’s refund of a large portion of his bond unnecessarily.
Given both parties’ relative success in their respective claims and defence to each other’s claims, I order suppression of both parties’ names.
The bond can now be disbursed to the parties as set out in the table above.
