On 15 June 2026 the landlord filed an application seeking termination of the tenancy, rent arrears, refund of the bond and reimbursement of the filing fee.

The hearing proceeded by way of video conference. The parties appeared by telephone. Termination and possession

Under section 55(1) of the Act, the Tribunal must, subject to subsection 55(2) terminate the tenancy, if at the time the application was filed, the rent was at least 21 days in arrears.

Under section 56(1) of the Act, the Tribunal may terminate a tenancy if the tenant has failed to remedy a 14-day breach notice for rent arrears, and it would be inequitable to refuse termination.

Under section 56(2) of the Act, if an application is made under section 56(1) and, at the time of the hearing the rent was at least 21 days in arrears, the Tribunal shall determine the application as if it had been made under section 55(1) and (2) of the Act.

On 24 April 2026 the landlord the landlord served a 14-day breach notice for rent arrears totalling $900.00. The notice expired on 8 May 2026 and was not remedied.

When should the landlord get possession of the property?

During the hearing the parties turned their mind to the making a conditional termination order.

The tenant said the rent arrears accrued while he was in custody. He said he had arranged for a third party to pay his rent but, following his release, discovered the rent had not been paid and the property had been emptied of some of his possessions. The tenant wants to pay the rent arrears to avoid termination of the tenancy. He told the Tribunal he intends to apply to Work and Income (WINZ) for a grant to clear the rent debt. In the alternate the tenant said he will ask family for financial assistance.

The landlord told the Tribunal they are not a registered landlord with WINZ. They said they will not apply to become a registered landlord and that their apartment building does not allowing social housing. The landlord was sympathetic to the tenant’s situation. The landlord acknowledged that since returning to the property the tenant has resumed his rent payments. The landlord said they are prepared to give the tenant six weeks to clear the arrears. If the arrears are cleared, they may consider allowing him to remain in the property until the end of the fixed term.

The landlord asked for the tenancy to be terminated, rent arrears to be ordered, the bond to be refunded and for possession of the property on Wednesday 19 August 2026. This is to give the tenant an opportunity to clear the arrears.

Having heard from the parties and considering all of the evidence the Tribunal finds is appropriate to order possession of the property on Wednesday 19 August 2026 at 11:59pm. This will provide the tenant with an opportunity to clear the arrears with the agreed support of the landlord. Other matters

Because [The landlord/s] has wholly succeeded with the claim I must reimburse the filing fee.

Section 95A of Act provides that on the application of a party that has been wholly or substantially successful in proceedings, the Tribunal must order that the name or identifying particulars not be published, unless the Tribunal considers that it is in the public interest to publish the names of the parties, or is justified because of the parties’ conduct, or any other circumstances of the case. Despite being wholly successful the landlord did not seek name suppression.

The tenant seeks name suppression on the basis he does not want to be “black listed” by future landlords.
