Order
- The tenancy of [The tenant/s] tenant/s] at 3A Impala Place, Hillsborough, Auckland 1061 is terminated, and possession is granted to Ray White Remuera Property Management Limited As Agent For Chanelle Stride, at 5:00pm on Wednesday 29 July 2026.
- [The tenant/s] tenant/s] must pay Ray White Remuera Property Management Limited As Agent For Chanelle Stride $5,311.57 immediately, calculated as shown in the table below:
Reasons
- The landlord attended the hearing. The tenant did not.
- I am satisfied that the tenant had received proper notice of the hearing time, date and place and chose not to attend. I tried to call the tenant on the mobile number in the application but she did not answer the call.
- The landlord has applied for termination of the tenancy, rent arrears and reimbursement of the filing fee
Should the tenancy be terminated?
- The landlord has proven that rent was at least 21 days in arrears on the date the application was filed and was still in $5,283.57 arrears to 31 July 2026. The tenancy is terminated from 5:00pm on 29 July 2026, as the Tribunal, under s55(1)(a) of the RTA, has no discretion and must terminate the tenancy.
How much is owed for rent?
- The tenancy ends on 29 July 2026, but because the landlord cannot, pursuant to section 138(1)(a) of the District Court Act 2016, enforce the eviction order for 48 hours, and is unlikely to be able to take possession of the premise until 31 July 2026. This gives the tenant time to move any belongings out of the premise that she wants to retain.
- The landlord provided rent records which prove the amount owing to 31 July 2026. Reimbursement of filing fee
- Section 102(4) of the RTA confirms that applicants that are wholly or substantially successful in proving their claims will have their filing fee reimbursed
- Because Ray White Remuera Property Management Limited As Agent For Chanelle Stride has wholly succeeded with the claim I must reimburse the filing fee.
