The Landlord has produced evidence to show that the Tenant passed away on 5 June 2026. [Redacted], the owner’s property manager, attended the premises that day. She gave evidence that she spoke with a Police Officer, who advised her that the Tenant had passed away.

The property manager says that she has attempted to obtain written confirmation from the Police, but was told that it would take 20 working days for a file to be opened, and then a further two or so weeks for the request to be considered.

The property manager has also attempted to contact the Tenant’s next of kin, without success. The Landlord has therefore applied to the Tribunal for orders terminating the tenancy. Ending a tenancy where the sole tenant dies

I accept the property manager’s evidence that the Tenant has passed away. Although she has provided no documentary evidence, I accept her evidence that she attended the premises on 5 June 2025 and that a Police Officer at the scene confirmed the Tenant’s death, on that day. I also note that the Tenant has not responded in any way to this claim, and no rent has been paid no rent has been paid since 11 June 2026. The Landlord’s rent records go back 11 years. The Tenant had never previously missed a rent payment. The combined evidence satisfies me that the Landlord has proven that the Tenant has passed away.

The tenancy agreement shows that the Tenant was the sole tenant. Where a sole tenant has died, the Tribunal may terminate a tenancy where the Landlord has been unable to give the personal representative of the tenant, or the tenant’s next of kin, written notice to vacate the premises. 1 The Landlord has been unable to do that. It does not have contact details for the Tenant’s personal representative or next of kin. It has tried to find that information. It has asked the Police and performed online searches, including on Facebook. No representative or next of kin have been found.

I therefore accept that the Landlord has been unable to give notice to the personal representative or next of kin in a timely way. Termination and possession

I consider it appropriate to order that this tenancy terminates. Doing so will ensure that the Landlord gains possession in a timely way, but also prevent further rent arrears accruing against the Tenant. In making this order, I note that the Landlord has responsibilities relating to any belongings left behind. 2 It must comply with those responsibilities. Rent arrears
