The hearing was conducted via video conference.
Ms Uljanova, the property manager, appeared on behalf of the landlord.
I attempted to contact the tenant, Mr Lyall, on the cellphone number provided in the application. Ms Uljanova advised me that Mr Lyall was unlikely to participate. a. When the call connected, the person who answered denied being Mr Lyall. The person stated that Mr Lyall was not at home and that he had answered Mr Lyall’s phone. When I asked about his relationship to Mr Lyall, he said that he was a flatmate. The call then ended. b. Ms Uljanova immediately told me that the person I had spoken to was Mr Lyall. She said he was the tenant and that he had been lying when he claimed to be a flatmate. I then attempted to contact the person again using the same cellphone number. This time, the person did not answer. c. I left a voicemail message. In that message, I recorded that I understood I had just spoken to him, that he had said he was a flatmate, but that Ms Uljanova had identified him as the tenant named in the application. I advised him that, as he was not answering the phone or participating in the hearing, the hearing would continue in his absence.
Based on Ms Uljanova’s evidence, I was satisfied that reasonable steps had been taken to contact Mr Lyall and give him an opportunity to participate. I proceeded with the hearing in his absence.
The landlord has applied for termination of the tenancy, rent arrears and refund of the bond.
Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.
The landlord provided rent records which prove the amount owing at the end of the tenancy. Filing fee
