On 6 July 2026 the landlord filed an application seeking termination of the tenancy for: a. Rent arrears – see section 55(1)(a) of the Residential Tenancies Act 1986 (the “Act”). b. Breach of the tenant’s obligations, specifically breach of section 40(2)(c) of the Act which states the tenant shall not interfere with the reasonable peace, comfort, or privacy of any of the landlord’s other tenants – see section 56 of the Act.

The hearing proceeded by way of video conference. Ms Anthea Eder, Senior Tribunal Adviser, appeared for the landlord. The tenant failed to appear. The Tribunal was satisfied the tenant was properly served with the notice of hearing (to their email address for service) and the case proceeded in their absence. History of the tenancy

The tenancy commenced on 12 December 2025 and was periodic.

On 12 January 2026 the landlord received complaints from a neighbouring tenant alleging loud noises and fighting at the property.

On 30 January 2026 the landlord and tenant met and discussed the reported behavioural concerns. The tenant was reminded of his obligations under the tenancy agreement and the Act. The landlord said the tenant took responsibility for his actions and indicated a willingness to improve his behaviour.

On 12 March 2026 the landlord received further complaints of yelling, fighting and disruptive behaviour occurring at the property from a neighbouring tenant.

Two section 55A, antisocial behaviour notices were issued to the tenant by the landlord. The first was dated 16 February 2026 and the second was dated 13 March 2026.

On 16 April 2026 the landlord received a further complaint from neighbouring tenants. The allegation was made that the tenant and his partner has burgled a neighbouring tenants property, stealing a number of items. Video footage of the alleged burglary was provided to the Tribunal.

On 1 May the landlord discussed the alleged burglary with the tenant who denied any involvement.

Should the tenancy be terminated?

Under section 55(1) of the Act, the Tribunal must, subject to subsection 55(2) terminate the tenancy, if at the time the application was filed, the rent was at least 21 days in arrears.

The landlord provided up to date rent records with prove the amount owing.

The application was filed on 6 July 2026. At the date of filing the tenant’s rent arrears totalled $270.00. Rent was at least 21 days in arrears and the tenancy is terminated.

At the date of hearing the tenant’s rent arrears totalled $401.58. The amount claimed is ordered.

The landlord has raised concerns about the antisocial behaviour exhibited by the tenant and their associates at the property. They allege that this behaviour is interfering with the reasonable peace, comfort, and privacy of their other tenants. Evidence was provided to support the landlord’s claims. Having heard from the landlord and considering all of the evidence the Tribunal finds it appropriate to grant the landlord possession of the property at 11:59pm on Thursday 16 July 2026.
