Reasons

This tenancy started on 5 June 2026. The weekly rent is $540, and the tenancy agreement records that rent is to be paid weekly, in advance. The Tenants have regularly underpaid the rent by $270 per week since shortly after the start of the tenancy.

On 29 June 2026, and on three subsequent occasions, the Landlord sent a notice requiring the Tenant to remedy their failure to pay the rent within 14 days. The Tenants have not remedied that failure, so on 15 July 2026 the Landlord applied to the Tribunal to terminate the tenancy and order that the Tenant must pay the rent arrears.

The Tenants agree that the rent is in arrears. They say that this is due to delays in the Ministry of Social Development processing an application for increased accommodation support and one of the Tenants not realising that a payment made to him by the Ministry of Social Development was for rent rather than backpay. It seems that he spent that money on something other than rent. The Tenants want an opportunity to catch up on their rent arrears and remain in the premises. The rent arrears

The Landlord has produced the tenancy agreement and rent summary and bank account records. The Landlords say that those documents show rent arrears of $1,890 as at the date of the hear today’s date.

I have examined those records closely. The rent arrears claimed by the Landlord are for the period up to 13 August 2026. Rent accrues day to day in residential tenancies. 1 That means the Landlord’s figure includes an amount for rent that had not yet accrued. I cannot take unaccrued amount into account when determining the rent arrears.

I therefore find that the rent arrears up to and including the day of the hearing, which is the different between the total amount paid by the Tenants and the rent accrued up to the date of the hearing, was $1,658.57, which equates to 21.5 day’s rent. Termination and possession

The Tribunal must terminate a tenancy is the rent is in arrears by 21 days or more at the date of the hearing, and the landlord has issued a 14-day notice requiring a tenant to remedy those rent arrears. 2 1 Residential Tenancies Act 1986, section 31(1). 2 Residential Tenancies Act 1986, sections 55(1)(a) and 56(2).

I decline to make this order conditional. 3 The Tenants have consistently underpaid the rent since the start of the tenancy. I acknowledge the Tenants’ claimed difficulties in engaging with and obtaining extra support from the Ministry of Social Development, but they were given many opportunities by the Landlord, by way of the four 14-day notices, to remedy these breaches, or at least make arrangements for the repayment of the rent arrears. They were unable to do that, and I cannot be reasonably satisfied that the Tenants will now promptly remedy this breach or that a similar breach will not occur in the future. I acknowledge that the Tenants have now received confirmation from the Ministry of Social Development that they will receive an accommodation supplement, but that additional supplement is for $270 per week, which is insufficient to cover any rent arrears.

I therefore order that the tenancy is terminated under section 56(2) of the Residential Tenancies Act 1986. Possession is also granted to the Landlord from 3pm 14 August 2026. 4

I make these orders reluctantly. I acknowledge the Tenants’ situation, and that the termination of their tenancy will be hugely disruptive. But because the rent is in arrears by 21 days or more, I must terminate the tenancy – I have no other choice – and the circumstances of this case just do not justify making that termination order conditional. Filing fee and bond

The Landlord has been wholly successful in its claim. It is entitled to recover the filing fee of $29. The Landlord does not seek name suppression. Neither did the Tenants.

I order that the Bond Centre is to refund the bond of $3,743.29 to the Landlords. The balance of the bond is to remain at the Bond Centre.
