Where rent is at least 21 days in arrears on the date the application was filed, the Tribunal must make either a final or a conditional termination order. See section 55(1)(a) and (1A) Residential Tenancies Act 1986.

The tenant says she will be able to pay the arrears in full through an application she has underway to access her Kiwisaver funds and will make sure future rent is paid when due through direct payments from ACC.

The landlord agrees to give the tenant a final opportunity to clear the arreas on the terms set out in the above orders.
