At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.
The tenant did not leave the premises reasonably clean and tidy, and did not remove all rubbish. The tenant did not return the swipe cards.
Photographs produced by the landlord show the tenant left rubbish and mess everywhere, upon vacating the premises. The premises have been left in an utterly filthy condition, and there are unexplained holes in a number of the walls. The landlord is not claiming the costs of repair because the landlord has decided to renovate the premises.
The amounts ordered are proved. The landlord should also have submitted photographs showing the condition of the premises at the outset of the tenancy, so that the usual comparison could be made, however, on this occasion, I am satisfied that the condition of the premises on exit makes it clear the condition of the property has been caused by a recent occupant, being the tenant.
Because [The landlord/s] has wholly succeeded with the claim I must reimburse the filing fee.
