Reasons

This matter was scheduled for a telephone hearing. There was no answer from the tenant when I called on the number available, being the number on the tenancy agreement. I am satisfied that the tenant has been notified of the hearing, so I will proceed to consider the landlords application in her absence.
The landlord has applied for termination of the tenancy for abandonment, rent arrears and refund of the bond.

Should the tenancy be terminated?

The Tribunal may terminate the tenancy where the premises have been abandoned and rent is in arrear at the hearing date. See section 61 Residential Tenancies Act 1986. A tenancy is abandoned where the tenant leaves the premises without reasonable excuse, not intending to return or to meet their obligations, and fails to notify the landlord.
Following an inspection on 27 June 2023, the landlord became aware (or ought to have been aware) that the tenant had abandoned the premises. I have considered the photographs taken by the landlord at the time of that inspection, and agree the premises seem abandoned.
Because the premises have been abandoned, and rent is in arrear at that date, the tenancy is terminated immediately.

How much does the tenant owe?

The landlord provided rent records which prove the amount owing at the end of the tenancy. The amount ordered includes rent in lieu of notice, being 28 days of rent following the above date of 27 June 2023. This rent arrears is ordered to be paid, offset by the bond to be released to the landlord.
