The landlords’ representatives and the tenant attended the hearing today.

The landlord has made an application for termination of the tenancy because the rent was in arrears and there had been no contact from the tenant.

Most of the rent arrears have now been paid and there is a redirection in place so that weekly rent is always paid on time.

There is still a small amount owing ($214.00) to make sure that the rent is always one week in advance. The most recent water bill ($69.76) is also due.

I am satisfied that the landlord did serve a notice on the tenant requiring them to remedy the rent breach within at least 14 days but the tenant did not do so and did not communicate with the landlord to try to make a payment plan. The amount owing caused the owners financial difficulty. I agree that it is fair and reasonable to make a conditional termination order. See section 56(1) Residential Tenancies Act 1986.

I consider that the tenant will pay the remaining amount owing and is unlikely to commit any further breach. I make a conditional termination order that the amount of $304.20 (this includes the filing fee on this application) must be paid by 5:00pm this Thursday 14 September 2023 or the landlord will have the right to terminate the tenancy. See section 78(3) Residential Tenancies Act 1986.

The conditional termination order will lapse if it is fully complied with. If the tenant breaches the order, the possession order is enforceable for 90 days from the first breach. See section 64(4)(b) Residential Tenancies Act 1986.

Both parties seek suppression of name. The landlord is entitled to this because the application has been successful.

After weighing up the interests of the tenant and the public interest, and with the consent of the landlord, I also suppress the name of the tenant from the published order on this occasion. The tenant’s rent record is good apart from this recent occasion, she took steps to have the arrears paid and to redirect her rent, and she was present at the hearing today. This is her first experience at the Tribunal. Often, this sort of claim would be resolved by mediation which is private to the parties (mediated orders are not published).
