An application for suppression has been made in this case, and the Tribunal orders suppression of the Tenant and Landlord’s name and identifying details.
[The tenant/s] must pay [The landlord/s] $869.01 immediately, calculated as shown in table below.

Reasons

Both parties attended the hearing via teleconference.
The landlord has applied for rent arrears, compensation and reimbursement of the filing fee following the end of the tenancy.
By consent, the Tenant agreed to paying rent arrears of $628.57. The Bond had been refunded to the Landlord from the initial hearing of this matter and applied to the rent arrears. The amount of $628.57 was outstanding.
By consent, the Tenant agreed to paying the cleaning and rubbish removal fee however she submitted that the condition of the property at the end of the tenancy was beyond her control and not caused by herself.
As [The landlord/s] has wholly succeeded with the claim, the Tenant must reimburse the filing fee. Name suppression
Section 95A of the Residential Tenancies Act 1986 provides that: “(1) The Tribunal must, on the application of a party that has wholly or substantially succeeded in proceedings, order that the party’s name or identifying particulars not be published, unless the Tribunal considers that publication is in the public interest or is justified because of the party’s conduct or any other circumstances of the case (4) The Tribunal may, on the application of any party to proceedings or on its own initiative, having regard to the interests of the parties and to the public interest, order that all or part of the evidence given or the name or any identifying particulars of any witness or party not be published”.
The Tenant has submitted that the disclosure of her identifying details would compromise her safety. I accept this and shall grant name suppression to the Tenant. The Landlord has not requested name suppression however to protect the safety of the Tenant, the Tribunal on its own initiative also orders the names and identifying details of the Landlord to also be suppressed.
