The landlord’s claim for water rates is dismissed

Reasons

The landlord attended the hearing which was held by telephone. The tenant did not attend. I called the tenant twice during the hearing on the phone number provided in the application. Both calls went to voicemail.
The landlord has applied for termination of the tenancy, rent arrears and water rates.
Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) & Residential Tenancies Act 1986. While the tenant has paid a lump sum towards the arrears, I could not be satisfied on the evidence before me that s55(2) applies to this situation. Arrears have been an issue throughout this tenancy.
The landlord provided rent records which prove the amount owing at the end of the tenancy.
The landlord also claimed water rates and provided a bundle of invoices from Watercare in support of its claims. Mr Faruk said that the tenant owed “close to $1,500.” The landlord did not provide a clear breakdown of the amount claimed or evidence of payment being sought from the tenant for water rates. The landlord did not establish its claims for water rates to the required civil standard. The claim for water rates is dismissed.
As the landlord was substantially successful, I have awarded reimbursement of the filing fee.
