Reasons

[The landlord’s representative] attended the hearing by teleconference on behalf of the landlord. The phone number for the tenant, Ms Wilson, the last three digits being 386, was called three times over a 10-minute period. All calls went to voicemail. As the tenant was served, the hearing proceeded in her absence.
The landlord has applied for termination and possession, rent arrears, outgoings, refund bond and refund of the application fee.
During the hearing, the landlord said the tenant has moved out and so they withdrew their claim for termination and possession.

How much is owed for rent and water rates?

The landlord said they discovered the tenant had moved out late at night on 11 September 2023, without providing any notice to the landlord. The landlord claimed rent arrears to 12 September 2023, which I find is reasonable in the circumstances. The landlord provided rent records which prove the amount owing to 12 September 2023, which is $4,371.43.
In their application, the landlord claimed $28.30 for a water bill owing by the tenant for July 2023. The landlord provided a Watercare invoice and tenant ledger. The Watercare invoice was for the whole building of 10 units but the landlord said each unit had a sub-meter and provided the meter reading for the tenant’s unit for this period.
During the hearing, the landlord sought to claim $40.40 instead for water bills owing by the tenant. However, no Watercare invoice was provided by the landlord for the next water period, nor had the tenant been notified in the application that the landlord was claiming this increased amount. As such, I find the landlord has proved their claim for $28.30 owing for water by the tenant only.
Because [The landlord/s] has been successful with the claim I must reimburse the filing fee.
The landlord requested suppression. As they have been successful with the claim, they are entitled to suppression. Therefore, I order that the landlord’s name and identifying details are not to be published.
