Lisa Chapman must keep the goods in safe storage until either the expiry of the 14 days without any contact from Chelsea Burrows or the expiry of the date agreed to or Ms Burrows to collect the goods.

If Chelsea Burrows does not contact Lisa Chapman within 14 days of the date of this order or she does not collect the goods and documents on the date agreed: a. Lisa Laurel Chapman must take any personal documents including photographs, belonging to the tenant, to the nearest Police station and obtain a receipt for them; b. Lisa Laurel Chapman must sell the remaining goods that have a saleable value by public auction or by private contract at a reasonable market price.

Lisa Laurel Chapman must pay the proceeds of any sale to the Bond Centre together with a copy of this order.

Ms Chapman has applied for rent arrears, compensation, and reimbursement of the filing fee following the end of the tenancy.

How much is owed for rent?

The Tribunal made an order terminating the tenancy on 27 June 2023 for non- payment of rent. The Tribunal also made an order that Ms Burrows pay rent arrears to 22 June 2023 and the Tribunal application fee. That order is incorporated into this order for enforcement purposes.

Ms Burrows vacated the premises on 27 June 2023 and Ms Chapman claims rent from the 23 June until the tenancy ended.

The amount has been established by the evidence of Ms Chapman.

Did the tenant comply with their obligations at the end of the tenancy?

Ms Burrows did not leave the premises reasonably clean and did not remove all rubbish and belongings as required by: section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986 (the Act).

Ms Chapman, her partner, and mother-in-law completed the cleaning and rubbish removal work themselves. She claims compensation for time spent totalling 16 hours at $35.00 per hour. When a landlord does work themselves on a property an hourly rate of $25.00 is considered reasonable. Ms Chapman also claims costs to hire a rug doctor, cleaning solution, and to purchase rubbish bags.

A tenant is only required to leave the premises reasonably clean and tidy. There will often be additional cleaning work required by a landlord to bring it up to a standard that the landlord might like for another tenant or occupant. Thus, doing the best I can on the evidence before me I consider compensation of $300.00 to be reasonable to compensate the landlord for the rubbish disposal work and the cleaning work. Ms Burrows’ goods left at the premises

Ms Burrows left goods at the premises at the end of the tenancy. On 17 August 2023 Ms Burrows contacted Ms Chapman wanting to make a time to collect her goods. Ms Chapman replied saying that her goods, including her washing machine and fridge freezer, had either been sold or disposed of. However, this was not entirely true. Ms Chapman still has some of Ms Burrows’ goods, including her fridge freezer and washing machine, in her possession. She said that she also has documents and photographs including a canvas print of Ms Burrows’ son.

I therefore give Ms Burrows the opportunity to collect these goods and documents. She must contact Ms Chapman to arrange a time for their collection as soon as possible but no later than 14 days from the date of this order if she wishes to do so.

In the meantime, Ms Burrows must keep the goods in safe storage (they should not be being used) as set out in order 3 above.

If Ms Burrows does not contact Ms Chapman within 14 days or does not collect the goods at the time agreed, Ms Chapman may dispose of the goods and documents in the manner set out in order 4 and pay the proceeds of any sale to the Bond Centre.

Ms Chapman has been mostly successful I her claims and I consider this an appropriate case to award her payment of the Tribunal application fee.
