Reasons

Only the landlord attended the hearing.
Just minutes before the hearing commenced, the tenant contacted the Tribunal to say that there was a childcare emergency and she wanted an adjournment until later today or tomorrow.
The Tribunal attempted to contact her at the telephone numbers provided but she did not respond.
The landlord said the tenants have previously used this childcare excuse in avoiding contact and that she understands the child involved is 13 years of age. The landlord’s evidence is that the tenants have made many promises to arrange payment with various excuses being offered, such as, there is a problem in getting funds released from Westpac.
The rent arrears are now substantial and the Tribunal decided to proceed to hear the matter in the tenant’s absence.
The landlord has applied for termination of the tenancy, rent arrears and refund of the bond.
Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated, as ordered above. See section 55(1)(a) Residential Tenancies Act 1986.
