The landlord attended the hearing which was conducted remotely. Two attempts to reach the tenant were unsuccessful. The landlord understands that the tenant is currently in prison.
The landlord has applied for termination of the tenancy, rent arrears, compensation, refund of the bond and the filing fee.
Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.
The landlord provided rent records which prove the amount owing until 4 October 2023 was $4,150.00. The landlord has managed to rent the property to someone else. They had become aware that the tenant was on remand and had been in discussion with his father, and had been hopeful that the tenant would be released on bail and had indicated the arrears would be cleared.
