The landlord has applied for termination of the tenancy for breach of the tenant’s obligations.

Should the tenancy be terminated?

The Tribunal may terminate a tenancy for breach where, due to the nature or extent of the breach, it would be inequitable to refuse to terminate. See section 56(1) Residential Tenancies Act 1986.
Where the breach is capable of remedy the landlord must first serve a notice on the tenant requiring them to remedy the breach within at least 14 days and establish that the tenant has failed to do so.
The tenants have breached their obligations by failing to pay rent in accordance with their tenancy agreement since June 2022.
The landlord served a 14-day notice on the tenants on 29 September 2023 and the tenants did not quite remedy the breach within the required period. Despite this the parties have agreed to a conditional termination order. This is because the tenants’ circumstances have changed as [redacted] is now back at work full time after being off on maternity leave. Because of this they are now able to meet their rental requirements.
Accordingly, by consent I have granted a conditional termination order. The conditional termination order will lapse if it is fully complied with. If the tenant breaches the order, the possession order may be enforced for 90 days from the first breach. See section 64(4)(b) Residential Tenancies Act 1986.
The conditional termination order only applies to the non-payment of the rent arrears on the due date. The other debts being the filing fee and water rates are to be paid, but non-compliance with those payments will not result in termination, but a money order that is enforceable.
Because [The applicant/s] has wholly succeeded with the claim I must reimburse the filing fee.
Because this order is made by consent, it is appropriate that all party details are redacted from the published order.
