The tenancy of Salesi Tuinasau and Waisale Tuinasau at 3 Tui Road, Raumati Beach, Paraparaumu 5032 is terminated, and possession is granted to Jade Rental Properties Limited As Agent For Michael Brian Dolan, at 11.59pm on Thursday 9 November 2023.
The Bond Centre is to pay $916.35 from the bond of $$2,760.00 (5350171-002) to Jade Rental Properties Limited As Agent For Michael Brian Dolan immediately, calculated as shown in the table below.
The balance of the bond of $1,843.65 is to remain at the Bond Centre.

Reasons

Both parties attended the hearing which was held by teleconference.
The landlord has applied for termination of the tenancy for breach of the tenant’s obligations.

Should the tenancy be terminated?

The Tribunal may terminate a tenancy for breach where, due to the nature or extent of the breach, it would be inequitable to refuse to terminate. See section 56(1) Residential Tenancies Act 1986.
Where the breach is capable of remedy the landlord must first serve a notice on the tenants requiring them to remedy the breach within at least 14 days and establish that the tenants have failed to do so.
The tenants have breached their obligations by failing to pay rent and water rates when they fell due.
The landlord served a 14-day notice on the tenant on 28 August 2023 and the tenant did not remedy the breach within the required period.
It would be inequitable to refuse to terminate the tenancy because rent has been consistently in arrears and because the tenants have failed to maintain an agreed fortnightly rent and debt payment. This has meant that as at today’s date their rent is still in arrears and the water rates remain unpaid.

How much do the tenants owe?

Taking into account a payment last night of $314.12, which has been put towards the rent arrears, the rent record shows that as at today’s date the tenants owe $494.88.
The evidence also shows that the tenants owe $401.03 in outstanding water rates as at today’s date.
I am also ordering the tenants to reimburse the filing fee to the landlord because the landlord was wholly successful in the claim against them.
