Arnia Arona Ngaau Gotty and George Gotty must pay [The landlord/s] $5,784.80 immediately, calculated as shown in the table below.

The landlord has applied for rent arrears, compensation, and reimbursement of the filing fee following the end of the tenancy.

How much is owed for rent and water ?

The landlord provided rent records and water rates invoices which prove the amount owing at the end of the tenancy, being 26.9.23.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.
The tenant did not leave the garden and lawns reasonably clean and tidy. It was necessary for the landlord to spend time tidying up the lawn and garden. This was work the landlord did herself but I am satisfied in this case it was an appropriate charge.
The tenant did not return the keys and the landlord has proven the costs incurred as a result.
The landlord would also have sought an order for the bond except that no bond was ever lodged by the tenants. At the outset of the tenancy, they sent the landlord relevant documentation to prove that the bond had been lodged directly by them with the Bond Centre. The landlord thought it was unusual that they had lodged the bond direct but, given the paperwork supplied, she accepted that. She also received confirmation from the Bond Centre that a bond had been lodged.
Upon further inquiry however it transpired that the tenants only lodged $1 for the bond. The full bond was not lodged and the tenants appear to have set on a course to mislead the landlord about the lodging of the bond.
Similarly, they provided paperwork to the landlord to show that $1200 of rent in advance had been paid, whereas in fact only $1000 was paid.
Once again, the tenants appear to have directly attempted to mislead the landlord about the amount paid by way of rent.
The landlord is entitled to recovery of her filing fee.
