See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986. The tenant is required to replace worn out smoke alarm batteries during the tenancy. See section 40(1)(ca) Residential Tenancies Act 1986. The tenant must also replace standard light bulbs.
The tenants did not leave the premises reasonably clean and tidy, and did not remove all rubbish. The landlord has cleaned and tidied the property at its own expense and has not charged the tenants for the skip bin or labour for clearing the rubbish or for cleaning the premises.
The tenants did not return the keys. A locksmith was called and the locks changed at a cost of $432.00. Because the tenants did not return the keys, an eviction order was sought and actioned at the cost of $200.00/
The amounts ordered are proved.
Because the landlord has wholly succeeded with the claim I must reimburse the filing fee.
