The landlord attended this continuation hearing, set down to be conducted via video. Neither party joined. Calls out were made. The call to the landlord was answered. The calls to the tenants went unanswered. I was satisfied has been addressed previously and I continued with the hearing.
The landlord has applied for rent arrears, compensation, and reimbursement of the filing fee following the end of the tenancy.
There were further significant compensation claims. These are pending resolution with the landlord’s insurer. Rather than delay this application longer, the landlord withdrew all claims other than those determined in this order. A future application may be made for the those claims withdrawn today, ideally after the resolution of the insurance dispute so that actual losses of the landlord can be confirmed.

How much is owed for rent and water rates?

The tenancy ended on 8 June 2023. The landlord provided rent records and water rates invoices which prove the respective amounts owing at the end of the tenancy are as ordered.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.
The lawns and gardens were overgrown. Photos support the need and the cost is established in an invoice for $552.00. This amount is awarded in full.
The tenant did not return all of the keys. A lockbox had been broken. An invoice for key replacement ($300.00) and another for the lockbox ($97.88) were produced. A photo established the damage to the lockbox. Both invoices are awarded in full.
The cleaning claim was withdrawn at this time.

Is the tenant responsible for the damage to the premises?

The landlord believes so. As indicated above, all compensation claims for damage were withdrawn at this hearing pending resolution of the insurance dispute. A further application may be made for those claims to be determined. Bond
The landlord was uncertain about the bond status. From a review of the record at the Bond Centre it appears to have been released but to who and when is uncertain. I have made no order for the bond but if it was released to the landlord it should be applied against the debt in this order, reducing the monetary order accordingly. Application filing fee
