The landlord attended the hearing today.
The landlord has applied for rent arrears, compensation, refund of the bond, and reimbursement of the filing fee following the end of the tenancy. Rent
The sole tenant passed away on 12 December 2023. The landlord found out about the death on 14 December 2023. By analogy with sections 50A(1)(a), (b) and (c), pursuant to section 50A(1)(d) I determine the termination date of the tenancy as 4 January 2024 (21 days after the landlord was notified of the death by a neighbouring tenant).
Rent is owed to 4 January 2024. The landlord provided rent records which establish the rent owing. Cleaning, Rubbish, Locks, Replacement Furnishings
The tenant had an obligation to keep the premises reasonably clean and tidy during the tenancy.
The tenant had not kept the premises reasonably clean and tidy and did not remove all rubbish. The floors and surfaces needed cleaning throughout, including the oven and fridge. The landlord was able to contact the tenant’s family, but items of furniture remained at the premises which had to be removed.
The landlord had to change the locks to ensure the property was secure.
A curtain was missing at the end of the tenancy, which the landlord replaced. Damage
A landlord must prove that damage to the premises occurred during the tenancy and is more than fair wear and tear. If this is established, to avoid liability, the tenant must prove they did not carelessly or intentionally cause or permit the damage.
The carpet was very dirty at the end of the tenancy and had to be replaced in two bedrooms at a cost of $2,635.80. I award the insurance excess of $550.00 for each room, an award of $1,100.00. Filing fee and name suppression
