The tenants signed a fixed-term tenancy agreement that was due to end on 16 December 2023. Rent and water arrears
In about early November 2023, the tenants bought a house and asked to leave the tenancy early. The tenants moved out on 18 November 2023 but paid rent to 29 November 2023.
The owner decided to try to quickly sell the premises, which the tenants - initially at least - consented to. The premises did not sell, however. That being so, and there being no evidence that the landlord agreed to the tenancy ending early, the tenants are obliged to pay rent to 16 December 2023.
That was a falling out over the landlord not returning the bond and the tenants took proactive action to interfere with the attempted to sale of the premises. Those events do not bear on the calculation of rent in my view.
There are some modest water arrears also. Locksmith’s costs
The landlord had to remove a deadbolt from the front door and replace some locks after the tenants withdrew their consent for the landlord to enter the premises to attempt to sell it.
Given the nature of the dispute it was sensible for the landlord to replace the locks rather than try and retrieve the keys from the tenants.
I order the tenants to pay the locksmith’s invoice. Filing fee
The landlord has substantially succeeded in the proceedings. The Tribunal orders the tenants to reimburse the landlord for the filing fee. Non-publication
