This order incorporates the Tribunal order made on 5 February 2024.

Reasons

The landlord attended the hearing represented by Ms Evans. Both tenants were telephoned several times but did not answer the calls. They have been served with the notice of hearing; therefore it went ahead in their absence.
On 5 February 2024 the Tribunal made an order terminating this tenancy, and for rent arrears and water rates. The previous order is incorporated into this order for enforcement purposes.
The landlord has also applied for compensation relating to the end of the tenancy.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986 (RTA).
The landlord has established in evidence that the tenant did not leave the premises reasonably clean and tidy, did not remove all rubbish and did not return the keys for the ranch slider.
The claim for cleaning is reduced from the amount sought of $529.00 as that cost is not justified by the evidence. The photos do not establish that the property was left particularly unclean, and the property inspection report also confirms that the tenants left the property reasonably clean and tidy except for the windows in both bedrooms. Accordingly, the amount ordered is based on what is considered reasonable in light of the evidence provided.
There was also a broken window left in the tenancy when the tenants vacated. I find the tenants liable for this damage. 1
Final water rates to the end of the tenancy are also included.
