Reasons

The landlord attended the hearing. The tenant did not attend the video hearing. The tenant was called on two phone numbers, neither call was answered.
The landlord has made two applications that were heard today. The applications were both for rent arrears and water rates owing, in application 4767940 the landlord also applied for termination of the tenancy for breach of the tenant’s obligations to pay rent.

Should the tenancy be terminated?

The Tribunal may terminate a tenancy for breach where, due to the nature or extent of the breach, it would be inequitable to refuse to terminate. See section 56(1) Residential Tenancies Act 1986.
Where the breach is capable of remedy the landlord must first serve a notice on the tenant requiring them to remedy the breach within at least 14 days and establish that the tenant has failed to do so.
The tenant has breached their obligations by failing to pay rent on time. The tenant is 14 and half weeks in arrears.
The landlord has served numerous 14-day notice on the tenant, none of the notices given have resulted in the rent arrears being fully paid. The tenant did not remedy the breach within the required period.
It would be inequitable to refuse to terminate the tenancy because the tenants have been given numerous opportunities to bring the rent arrears up to date and have failed to do so.
The landlord has given the tenants a 90-day notice to terminate on the 7 May 2024 because the landlord intends to sell the property. The landlord tells me today that it is unable to afford the property, particularly when the tenants are not paying rent.
I am satisfied that the tenancy should be terminated immediately due to the rent arrears. The tenant has made no effort to bring the rent arrears up to date.
The tenant is also substantially behind in payment of the water rates. The landlord has provided the invoices from December 2023 to March 2024 which show the amount owing.
As the landlord has been successful in this application they are entitled to the filing fee and name suppression as requested.
