[The tenant/s] and [The tenant/s] must pay Barfoot & Thompson Limited As Agent For Harjit Dheil (Hsh Holdings Ltd) $6,297.65 immediately, as set out below.

Reasons

Both parties attended the re-hearing.
The rehearing is granted as it is accepted that Ms Moana did not attend the hearing as the call to her was disconnected, very soon after it commenced. The reasons for that are unknown.
The landlord had applied for termination of the tenancy, rent and water arrears and refund of the bond.
It is appropriate to make final orders about these matters. Ms Moana understands that if she wishes to make an application about the landlords’ dealings with the bond or breaches of healthy homes standards, she can do that, but must file an application setting out full particulars of those claims and providing relevant evidence to support the claims. That matter would then be set for a further hearing.
The tenancy ended shortly after the 31/1/2024 hearing. The landlord said the bailiff was arranged for 8/2/2024. Ms Moana said she had left the property a few days before this.
The rent is calculated until 2/2/2024 and the water invoices until 31/1/2024. The bond has subsequently been refunded to the landlord so is deducted from the amount awarded.
The rent ordered is only for the term of this tenancy which commenced on 7/12/2023 when a new agreement was signed.
If the previous landlord wishes to claim rent arrears for an earlier period, they may do so, but signing a new contract means the rent can only be awarded, as between the parties, for the period of this contract.
The landlord provided rent records and water invoices which prove the amount owing at the end of the tenancy.
Because Barfoot & Thompson Limited As Agent For Harjit Dheil (Hsh Holdings Ltd) has substantially succeeded with the claim I have reimbursed the filing fee.
