Both parties attended the hearing by teleconference.
The landlord has applied for termination of the tenancy, rent arrears, water bills and reimbursement of the filing fee. Termination:
Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.
The tenancy is to terminate by 11.59pm on Monday 26 th February 2024. Rent arrears and water bills:
The landlord provided rent records and water bills which prove the amount of $5595.71 in rent and rent arrears and $165.15 in water bills owing at the end of the tenancy on 26 th February 2024.
I am satisfied that the landlord has proven their claim for rent arrears and water bills. Suppression:
The landlord is seeking suppression of their details and as they have been successful in their application, I am granting suppression.
The landlord and tenant sought suppression of the tenants’ details. The tenants are expected to be able to pay off the rent arrears with the help of WINZ. The tenants have another appointment with WINZ on Wednesday 21 February 2024. It is anticipated that termination of the tenancy can be stopped once the arrears are paid in full this week.
The circumstances that have led to the rent arrears are not the fault of the tenants. They had to leave New Zealand and return home to Samoa for a family emergency. During the extended period of time they were required to be in Samoa, the arrears accrued. There were family members staying at the property who did not pay the rent as required. As the tenants are on the tenancy agreement, they are responsible for the rent arrears.
The landlord is sympathetic to the circumstances the tenants have found themselves in and do not want them to suffer any further difficulties if their names are not suppressed. This is a unique set of circumstances and so I am granting suppression for the tenants also in the interests of justice and fairness.
