Reasons

Mr Singh for the landlord attended the hearing which was held by telephone. The tenant was called twice at the start of the hearing on the phone number provided on the application but did not answer the calls.

On 18 January 2024 the landlord applied for termination of the tenancy, rent arrears, refund of the bond, and reimbursement of the filing fee following the end of the tenancy.

The matter was scheduled for a Tribunal hearing on 5 March 2024. On the day of the hearing the landlord made an application to adjourn the hearing as the rent arrears were $178.57 and as they had vacated debt charges which they wanted to add to the application. The matter was adjourned for the landlord to file further claims within 7 days.

The landlord did not file any further claims and the matter was re-scheduled for a hearing on 23 April 2024. On the day before the hearing the landlord again sought an adjournment noting that “there are a lot of damages at the property and we are still waiting confirmation from the insurance so kindly we hereby request you to adjourn the matter for a month.”

The adjournment request was not granted as the landlord had not filed any further claims amending the application as the previous adjudicator had directed. Any further claims for compensation after the tenancy ended can be made by the landlord filing a separate application.

How much is owed for rent?

The landlord advised that the tenancy had ended on 8 February 2024.

An up-to-date rent summary was not been provided before the hearing but was forwarded after the hearing had ended. The rent summary shows the tenant made a payment of $800.00 on 14 February 2024 which resulted in rent owing of $178.57. The rent summary shows a debit of $217.86 was made against the rent summary on 29 February 2024 which meant the rent summary records $396.43 is owing.

No explanation is provided for the $217.86 debit shown on the rent summary. I attempted to call the landlord back during the scheduled hearing time but the call went to voice mail. I am not persuaded this is a valid deduction from the rent paid by the tenant.

I order rent arrears of $178.57 to be paid by the tenant. The landlord is able to raise the reason for the debt as part of any future application it makes for vacated compensation.

As the landlord has succeeded with the claim I must reimburse the filing fee.

The remainder of the bond is to remain at the Bond Centre pending a further application from the landlord.
