The landlord has applied for rent arrears, compensation and reimbursement of the filing fee following the end of the tenancy. The bond in the sum of $1,500 has been paid to the landlord. Rent
The tenancy ended on 5 December 2023. The landlord provided rent records to prove the amount owing at the end of the tenancy as ordered. The Tenant’s Other Obligations
At the end of the tenancy the tenant must leave the premises reasonably clean and tidy and remove all rubbish.
The tenant must not carelessly or intentionally damage the premises.
A landlord must prove that damage to the premises occurred during the tenancy and is more than fair wear and tear. If this is established, to avoid liability, the tenant must prove they did not carelessly or intentionally cause or permit the damage. Tenants are liable for the actions of people at the premises with their permission.
Where the damage is caused carelessly, and is covered by the landlord's insurance, the tenant's liability is limited to the lesser of the insurance excess or four weeks' rent (or four weeks' market rent in the case of a tenant paying income-related rent). Claims and Awards
The premises were not left reasonably clean and tidy, and rubbish was left at the premises. The premises also suffered damage during the tenancy which exceeded fair wear and tear. The tenant did not disprove liability for the damage.
The landlord did a substantial amount of rubbish removal and cleaning after the tenancy ended.
He also carried out some repairs to the premises including replacing damaged and missing fittings including the laundry tub which could not be repaired and had to be replaced.
The landlord claims compensation for the time he spent on rubbish removal, cleaning and repairs. He put his time at 38 hours which was spent over a period of three weeks. He claimed compensation for his time at the rate of $50 per hour.
After seeing the photographs showing the condition of the premises at the end of the tenancy, I am satisfied that time claimed by the landlord is reasonable.
The Tribunal would usually award between $20 and $25 per hour for a landlord’s time. In this case the landlord plainly had some handyman skills which were above what would ordinarily be expected and by carrying out repairs and other work himself, he has reduced the cost to the tenant. I have therefore allowed $30 per hour for his time making a total of $1140.
He has spent money on materials and fittings that were either missing or damaged at the end of the tenancy and he produced evidence of the payments. I have therefore awarded the cost in full in the sum of $622.88.
There was other damage to the premises that the landlord did not attend to himself. The damage was mainly to doors in the premises. The landlord made an insurance claim for the damage and the claim has been accepted.
The landlord’s insurance policy carried an excess per event of $550 and the insurance company accepted five claims and applied the excess to each claim. I have therefore awarded the total of the excess in the sum of $2,750.
The landlord hired a skip to remove the tenant’s rubbish from the premises and I have awarded the cost in the sum of $295.
After completing a substantial amount of cleaning himself, the landlord employed cleaners to complete the general cleaning and carpet cleaning. I find that it was reasonable to do so and that the cost was reasonable. The carpet was heavily stained. I have therefore awarded $480 and $471.50 for the general and carpet cleaning respectively.
The landlord travelled from Amberly to the premises in Rangiora to carry out his work on there and claims $220 for his travelling costs. I have awarded the claim in full. Overall, the landlord has saved the tenant a significant amount of money by carrying out work himself rather than employing tradespeople and paying a commercial rate.
Because the landlord has been largely successful, I have awarded the filing fee.
I have given the tenant credit for the bond that has been paid to the landlord. The tenant must pay the remaining liability.
