Reasons

The landlord attended the hearing, the tenant did not attend. I rang the tenant twice on the mobile number provided in the application, but the calls went unanswered.
The tenancy commenced on 10 October 2022. The tenant had a few missed rent payments in the past but has largely been good with her rent. However, in February 2024 the tenant missed one rent payment and the rent increased from $645.00 to $655.00. The tenant has not made allowance in her rent payments for the rent increase. As a result of the rent increase and the missed payment there have been rent arrears of $698.57 as of 11 April 2024.
An added complication to the rent situation is that the tenant is not complying with the due date for payments. The landlord points out that the rent cycle is Friday to Thursday each week. The tenant’s rent is meant to be in advance, but the rent is not paid each week until the following Tuesday. Therefore, each week the rent is in arrears.
The landlord seeks the tenant to pay the rent arrears of $698.57, bring the rent cycle to Thursday each week and not the following Tuesday and to amend the weekly rent to reflect the rent increase.
The landlord had directed at the start of the tenancy that the tenant arranges a direct payment with WINZ each week for the rent. At present WINZ is paying the tenant directly and then she pays the landlord. The tenant has not arranged for WINZ to pay the rent directly to the landlord.
