Reasons

The landlord attended the hearing which was held by teleconference. The tenants did not attend. The tenants were contacted on the contact numbers provided in the application but without success. I proceeded with the hearing in the tenants’ absence as I was satisfied adequate service of the hearing notice had been completed.
The landlord has applied for rent arrears, unpaid water rates, refund of the bond, and reimbursement of the filing fee following the end of the tenancy.

How much is owed for rent and water rates?

This was a fixed term tenancy which started on 9 December 2023 and ending on 30 April 2024.
The landlord says there had been a persistent history of irregular rent payments/non-payment of rent from the start. He later learnt from Ms Kumar that Mr Singh had vacated the tenancy without giving notice. Due to Ms Kumar’s ongoing financial difficulties in paying the rent, he agreed to release her from the fixed term earlier (16 April 2024) on condition that certain terms were met. However, he later became aware that Ms Kumar had abandoned the tenancy on 9 March 2024. Multiple attempts were made by the landlord to contact the tenants but to no avail.
I note that one of the co-tenants gave notice and vacated the tenancy with the other tenant remaining in possession of the tenancy. However, both tenants remain joint tenants to the fixed term tenancy. That being the situation, they remained jointly and severally liable for the rent and water rates owed, liability for the debt not being apportionable between parties.
I find the tenants are liable for rent to the end of the fixed term tenancy, being 30 April 2024.
The landlord provided rent records and water rates invoices which prove the amounts owing at the end of the tenancy.
As the landlord has wholly succeeded with the claim, I must order the other party to reimburse the filing fee.
