If this is established, to avoid liability, the tenant must prove they or others at the premises with their permission did not carelessly or intentionally cause or permit the damage: sections 40(2)(a), 41 and 49B of the Act.
I am satisfied that the landlord has established that the following damage was caused during the tenancy, is beyond fair wear and tear, and the tenant has not disproved liability for the damage: • Hole in bedroom door; • Stains on toilet seat that could not be removed by cleaning; and • Stains on the main bedroom carpet that could not be removed by cleaning.
The amounts ordered are established by the production of invoices.
The claim to replace blown lightbulbs is dismissed because light bulbs that have blown due to ordinary use are considered to be ‘damage’ caused by fair wear and tear and therefore not the tenant’s responsibility to replace.
The landlord has been mostly successful in his claims and I consider this an appropriate case to award the Tribunal application fee.
