Reasons

Representatives of the landlord attended the hearing by video. The tenant did not attend and did not answer calls to the phone number that she had provided to the Tribunal before the hearing. She also did not answer calls made to the contact number provided in the application form.
The landlord has applied for rent arrears, compensation, refund of the bond, and reimbursement of the filing fee following the end of the tenancy.

How much is owed for rent?

The tenancy ended on 3 May 2024. The landlord provided rent records which prove the amount owing at the end of the tenancy.
The tenancy was assigned to this tenant (from her parents) in February 2024. There were rent arrears of approximately $4,000.00 owing at that time. The landlord has provided evidence that the tenant accepted and acknowledged liability for the rent arrears owed at that time.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.
The tenant did not leave the premises reasonably clean and tidy, and did not remove all rubbish. The landlord provided photographs and receipt for costs incurred.
Three net curtains were missing at the end of the tenancy. The landlord provided photographs and an invoice for replacement curtains.

Is the tenant responsible for the damage to the premises?

A landlord must prove that damage to the premises occurred during the tenancy and is more than fair wear and tear. If this is established, to avoid liability, the tenant must prove they did not carelessly or intentionally cause or permit the damage. Tenants are liable for the actions of people at the premises with their permission. See sections 40(2)(a), 41 and 49B RTA.
Some wall and door damage was caused during the tenancy. The damage is more than fair wear and tear, and the tenant has not disproved liability for the damage. The landlord provided photographs and an invoice to prove its claims.
As the landlord was the successful party, I have awarded reimbursement of the Tribunal application fee and granted the landlord’s request for suppression of its details.
